    Default Grey area child support w/foreign divorce decree

    I have 2 childern with my 1st x. She is a German national and the kids are the same and the divorce took place in Germany...I was not present. The order states that "support will be paid as ordered" but there is no mention of any amount. We had a verbal agreement, but again nothing in the decree. I am now living in NC (active Air Force) and would like to know if I can be liable for support. I read on the DFAS web site in the Uniformed Services Former Spouse's Protection Act that they cannot garnish wages from my pay because the court is foreign (does not have juristiction over me) but nothing is said in the child support section. Basically what I don't want is some foreign court ordering me to pay support when I have no chance to represent myself (as in my original divorce) and get hit up with a monster back payment order and possibly jail time.

    Default German Court

    Whether or not a U.S. court would regard the German court as having jurisdiction over you to order child support is going to depend upon the nature and extent of your contacts with Germany. It's hard to say more without a better understanding of your situation - you would be well-served to consult a family lawyer who is familiar both with the miliary's treatment of support orders and German family law. Perhaps your base legal office can suggest somebody.
