    Question Retail Fraud In Michigan

    My question involves criminal law for the state of: Michigan.

    Okay, so yesterday i was caught shoplifting 2 pairs of sunglasses from neiman marcus. I'm 17, i was arrested and taken to their sub-station in the mall where i was fingerprinted, and had my picture taken. They gave me a ticket with 2 charges, retail fraud ($174) and trespassing (i was banned from that mall)... So, I'm supposed to call the court to set up a court date within 10 days. What should I do? On the back of the ticket it said that I could pay my fines by mail without showing up in court, if I plead guilty and mail the ticket in. How long will this be on my record? Should I do this by mail? What can they actually charge me with? Both charges were marked as misdemeanors. Help me please!

    Is it possible I can pay the fines without going to court, like it says on the back of the ticket?

    Sure then its likely you will get a conviction and a theft on your record

    Since you have not shared with us the penal code of which you are charged and would (in essence) be pleading guilty to by paying fine we cannot say.

    You are being charged with retail fraud 3rd degree, which is a misdemeanor in Michigan. Thank God that you were under $200 (the cutoff for 2nd degree, which leads to a harsher punishment). You are only able to pay the fines by mail if it is a traffic related citation. (It does say this on the ticket, you just have to read it all, including the fine print). You are going to have to go to court, but it will probably only be two or three times. (Once for arraignment, once for pretrial negotiations/entry of plea, once for sentencing). I am currently going through the same thing that you are.

    I would call the court as soon as possible, as well as contact a criminal defense attorney. If diversion is available in your court, and this is your first offense, your attorney may be able to arrange this in a plea bargain - which would be very helpful, because you would essentially be avoiding a conviction and a criminal record. I am going to hope and pray that you can get diversion!
