    Exclamation What Should I Do About Debt Suit By LVNV Funding

    My question involves collection proceedings in the State of: Austin, Texas
    Travis County.....
    Ok I being sued for by a junk debt collector for an old account the debt collector is LVNV Funding, I’ve done some researching on the net and it seems like I have a good case since the original Account is from 2001 and is on my credit as closed, but they are trying to act like its current, by having it on my credit report again under there name, which is illegal, Right?
    So my question is what should I do, I know I have to respond in writing in so many days, or I get the default judgment. The Statue of limitations is 4 years in Texas so is that good defense to the suit with a copy of my Credit report..?

    A: I would certainly try that. Do not ignore this lawsuit; make sure you show up for each court date.

    What should the say when writting back? can I post a counter demand to remove this off my credit if I win, or should I just try to get them off my back for now saying that the sute is not legal ?

    If the SOL has elapsed, when answering include that in your defense. If you don't plead the SOL has elapsed in your answer, you waived that as your defense.
