    Default Hit And Run And Careless Driving In Minnesota

    My question involves a careless driving ticket from the State of: MN

    Me and my friends found out that one of our close friends had died. We were all at the bar (small town, no where else we could all get together). I had only two beers but hadn't eaten. We decided to go to the scene of the accident. As we were leaving the bar, I offered to drive a friends truck to my house (only two blocks away) so he wouldn't try and drive later on. As I was backing up, I hit another truck on the passenger side box. It looked very similar to another friend's truck, and that friend was in another car that was going to follow me. The people in that car were all saying "don't worry about it" so I figured it was that person's truck and we left. With everything else going on (being shocked and devastated about our friend's death, it didn't cross my mind to stop and make sure it was really my friend truck. Later on, a cop drove to our house and started asking questions. I admitted I was the one that hit the truck. He proceeded to ask me questions and gave me a road sobriety test and two brethalizers. I blew .092 and was taken to the jailhouse. The results of my urine test came back as .06 so I'm not getting a DWI, but I just received a notice in the mail that I have to appear in court for both careless driving and hit and run. The person whose truck I hit is willing to just let me settle with cash instead of through insurance. They are understanding and not upset. If I bring him to court with me and he says he doesn't want to press charges, will that help me at all? I'm in college and can't afford a lawyer, but should I fight this or just go and pay for whatever they give me?

    You hit someone's vehicle - while buzzed, no less - didn't do so much as leave a note with your contact information, and you want to fight it?

    You WERE careless and you DID leave the scene. You were busted fair and square. Face the music and pay what you're told to.

    Under MN law, both "careless" and "hit and run" are misdemeanors. You will have a "criminal" record as a result. If it were me, I'd hire an attorney. Try to get one of the charges dropped and the other reduced to an infraction, if possible.

    Now, if you're sure the other guy will help you out, you might be able to get off completely, assuming that the officer did not witness the event. If you plead guilty, the state will have to find witnesses to testify against you. If they simply don't show up, that should take care of it.

    I know what it's like to lose a good friend. For a while it seems like someone has rewired your brain and you just can't think clearly. Add a couple of beers and things that normally make perfect sense, don't anymore.

    But, I hope you've learned a lesson.
