My question involves alienation of affection law for the State of: Florida & North Carolina
I left my marriage last May filed for divorce last December in the state of Florida and started seeing a man in August who was also in a very unhappy marriage. All of this took place in Florida. Last August his wife moved her and her children (from a prior marriage) up to North Carolina to their new home. In December of 07' she started changing drivers license etc to establish NC residency. In February of 08' he moved up to NC because the construction on his house was complete. I moved up to NC in March of 08'.
As of April he has filed for divorce in the state of Florida, because she has not been in NC long enough to establish residency, and he is maintaining residency in Florida.
However, she knew about me in Florida and knew about me in NC and has recently as of last weekend been talking of suing me for alienation of affection and criminal conversation.
There are also email exchanges between them where WAY before i came into the picture they had discussed divorce and knew the marriage was dead.
My questions are...
1. Can she sue me in NC for Alienation of Affection or Criminal Conversation if we are all still considered residents of Florida? (Both he and i still have homes in the state of Florida)
2. Can she sue me in NC for Alienation of Affection or Criminal Conversation if her divorce is being handled in the state of Florida?
