My question involves landlord-tenant law in the State of: Georgia
I have been renting a house for about 9 months. We have had numerous problems with the house including cockroach infestation, clogged shower drain, and broken water heater that leaked so much water under the kichen floor that you could hear a squishing noise when walking. The house is in bad shape, but we did sign the lease, I realize that. The property management company has been pretty responsive to the many maintenance requests we have submitted. None of the requests were because of abuse we inflicted to the house.
The shower drain clogged up again recently, but this time, we received a bill for $85 in from the property management because, they said the plumber specified that hair was removed from the drain on the bill. When I approached the property managment company about this, they said it was not the responsibility of the landlord to pay this bill since it was our hair that clogged the drain and we should have tried to fix it ourselves. The house is really old and not in good shape, so we really thought we were doing the right thing by telling them instead of pouring a bunch of chemicals down the drain. The management company said they were only responsible for structural issues and making sure the property was fit to live in. By the way, this is the only shower in the house.
My question is, is hair clogging a shower drain considered normal wear and tear, and therefore the responsibility of the landlord? Or are we expected to pay for the plumber? Any advice is greatly appreciated!
