    Default Can An Illegal Entry Stay By Marriage?

    My friend's fiancée entered the US without papers using a fake visa, about 6 years ago. They have a child together and want to get married (she always wanted to but he was hesitant). He was caught driving without a license (3x) and is now being detained, and faces deportation. He just got a lawyer but the situation is not yet clear. She is a US citizen and thinks marriage will help him stay so he can raise his child in the US. If he does get deported, she wants to go with him to Ecuador and bring their baby too, until they can all return. Should they marry here or there? She thinks it would be an extreme hardship to have to leave or to stay without him. She doesn't want to let their child grow up without his father and she loves them both. At first, they told him don't worry, they don't deport for traffic violations. Any advice or ideas?

    I'm not a lawyer but, in all honesty, he should direct these questions to his lawyer.

    Illegal entry and posession/use of a fake visa are serious offenses. Driving without a license just adds insult-to-injury. These issues are NOT something the courts are going to take lightly, not to say what the INS will do.
