    Default Is Signing The Birth Certificate Final?

    My question involves paternity law for the State of: Mississippi.

    My fiance has a 15 month old daughter that he never established paternity with DNA or blood testing. We have recently found out that there is a very good chance that this is not his daughter but he signed the birth certificate when she was born. The mother does not want testing done to establish paternity and child support through the state because she "does not want to deal with the court system". She insist that he is the father and wants to continue their current financial arrangement but will not let him see the child as he wants because we are getting married.

    Even though she is 15 months can we still get around her mother and establish paternity? If the test reveal he is not the father is he free or is he still required to care for the child since she has his last name and he signed the birth certificate?

    Your finance NEEDS to file for paternity, custody, CS, and visitation ASAP.

    He can go through the state CSE agency, the court can order a DNA over the mother's objections, and until there is a court order, she does not legally have to allow him to see the child. Until a court issues an order, he does not have to pay CS either.

    If the DNA proves that he is not the father, he will be free from any obligation to the child.
