    Default Car Accident During Lunch Time

    My question involves an injury that occurred in the state of: CA

    I had a car accident during lunch hour. I was at work in the morning and in the afternoon. I got hit when my car was stopped at a red light. This is 100% the other car's fault. I got whiplash injury. The other person's car insurance is telling me for minor impact, they do not pay for much but could not tell me any amount. They said I should send my bills at the end and they will assess what they can reiumbursed.

    - Is it considered as a work related injury?
    - I already filed a claim with my insurance. any particular reason or advange to file a work injury?
    - Should I take a lawyer as early as possible in the medical treatment to help pay the final bill or simply wait until the end?
    - I do not have a police report since I know the other person who hit me. Is it a pb?

    You were on your time, in your car, going to or coming from a destination chosen by you, with no work element involved? Then no, it's not work-related.

    You're going to have trouble trying to make a substantial claim for what appears to be a minor injury where you were supposedly rear-ended by a friend and didn't bother to make a police report. The insurance company may well suspect collusion or fraud. If you decide not to settle and press for greater damages, you'll have to see what happens.

    I agree it would have been best to have made a police report. I would just hold at this time & see what the ins. co. offers. (& it's not a work-related injury as the other responder noted)
