    Default Conditional Permanent Resident For 2.5 Years Before Husband Died

    Hi all,

    I came here last year of 2005 married to an american citizen and got my permanent resident card non-conditional together with my daughter who is now 10 yrs old. Now, my question is, my hubby died mid last year and per my understanding, i wont be able to file my US citizenship this year before my anniversary date since hubby died and there was no continuous marriage with an American citizen thereof here. Now, i have to wait till 2010 to apply for citizenship as continuous resident of the United States instead then my daughter will acquire her citizenship thru me once i passed. Now, my ques is:

    1. If i plan to get married this year, how will this affect me applying for my citizenship on 2010?

    2. Do I have to start from counting from the beginning as him my new hubby?

    How long were you married before your husband died? You may be eligible to remove the conditions on your Green Card despite being widowed. (See the USCIS website.)

    Hi, thanks for responding. I was married to him for 3 years and 3 months till he died. I and my daughter were given a 10 yr greencard the day we arrived in the United States. We came here as IR1 and IR2. Immigrant status. In my own understanding with the immigration law for naturalization is that one can apply for citizenship as continued married to an american citizen for 3 years but since in my case, he died before my 3rd year anniversary which is this year, i can still apply for citizenship as 5 year continued resident of the United States. And as far as I know, the 10 yr greencard that I have is fine till I become a citizen of the United States. Am i right?
