My question involves landlord-tenant law in the State of: SC
I pay rent in a owner-occupied house, where I rent a bedroom. I recently bought a house and moved out of the owners house. This is a single unit house, so I share common areas with the owner. The owner, who I signed a residential lease agreement with, has agreed to allow me to sublet the room, however she wants full control, and hasn't listed the room for sublet in classified ad venues (ie: craigslist). She originally agreed to ask for a discounted rate of rent for the subletter (I was to pay the difference so the owner would receive full rent). Now the owner doesn't want to advertise the room at the discounted rate, because she feels that it will attract undesirable people!
My main concern is that we have lost a few weeks of advertising time and she seems to be increasingly uncooperative.
Can anyone give me advise regarding this arrangement?
1. Is the owner operating legally here? (She is a new owner and I'm sure that her loan stipulates that her home be a single family residence.) Is the lease valid?
2. Can anyone direct me to specific parts of the SC law that deal with owner-occupied home room rentals? Is she classified as landlord or a roommate?
3. Can I take control of the sublet situation, instead of her? ie: post my own ads , and recruit someone?
