    Default Chaning My Son's Last Name Texas

    My question involves name change laws in the State of: Texas

    My son's biological father left when he was 10 months old and moved to Florida. I had to file for child support to get Child Care benefits so that I could work to support us. We have been to take a couple of paternity test but as far as I know his biological father never took the Florida Court ordered blood test. I have never received any documentation that child support or paternity was determined and have not pursued it because he was a confessed drug addict.I spoke with him about a year ago and he said he had never been to court but recieved papers a few years back for a court ordered blood test. Last I spoke with his mother she did not know where he was at since he left his 3rd rehabilitation in the past 4 years. My son's biological father's name is not on his birth certificate because he put down the wrong Social Security number on the paperwork however he does have his last name. The man I just married has been the only father my son has know. He started helping me take care of him when he was two. I want to legally change my son's last name when I go to the Social Security office to legally change mine to my husbands. Can I do this since his biological fathers legal rights have never actually been determined?

    Because the process for determining paternity and CS was already started, you need to follow up on that first. You mentioned you recieved assistance, so ther might be an order that has already established paternity and CS. You can contact the state CSE to find out what the status of the case is. (since ex refused to go for court ordered DNA, he might have been found to be the legal father by default)

    You will need the legal father's permission to change the name, or get a court order allowing it.
