    Default Continuing To Receive Direct Deposit After Terminating Employment

    Hi everyone,

    I recently gave my two weeks notice to my employer (in Illinois). On my last day they informed me that they would direct deposit my paycheck as usual that day (we were paid 1 week after working) and gave me a check for the current weeks employment. I thought everything was finalized, that was on April 4th. I did not receive a direct deposit on April 11th as they explained, but then on Friday the 18th, I received another direct deposit from my former company.

    Another piece to my unexplained direct deposit is that I had been on maternity leave for 3 months. When I returned on Monday, March 24th I received a check the following Friday, even though we are not paid in the current (I put in my notice the same day). This paycheck was for my normal amount. Since I had been on FMLA I owed money to them for insurance so I authorized HR to deduct the amount from my next two paychecks, the amount that was just deposited is the same as my past two checks, not my regular pay.

    What should I do? Can my former employer simply reverse the direct deposit? I heard a rumor about this happening to someone else at the company and they just stopped getting checks one day (6 mo later). The HR dept was horrible there, I am almost certain someone hasn't turned off my direct deposit. Any help would be great!

    if yourecieved money that you should not have, it is not your money and must be returned to the originator. If you attempt to keep the money, you will be held accountable when the mistake is discovered and would be required to repay it. If you fail to do so, they will take action to recover the money. If you play with this long enough, it could become a criminal matter and you could be tried for it.


    Contact your former employer. Tell them of the mistake. Ask them to correct the improper payments and the two of you decide how the money is to be returned to them.
