My question involves small claims court in the state of: Oklahoma

Long story short- I wanted to sell my motorcycle and my new roomate took it out without asking and wrecked it. We agreed that he would buy the bike from me. He told me he would get a loan and pay for the bike.

Three months have passed and he still has not paid me and refuses to answer my calls making it impossible to deal with the situation. Since the wreck he has bought a new truck and now says that he cannot get approved for another loan to buy the bike or pay the damages (which I have obtained an estimate for.)

I did not file a police report when it happened because I considered him a friend at the time.

I have a series of questions about what I can now do?

First: Is it too late to file a police report?

Second: What type of paperwork/forms/police reports, if any, do I have to file in order to proceed?

Third: Can I file a report for theft even though he returned the bike?

Fourth: If we will end up in court over this I am afraid he will get off with only paying damages and I will be stuck with the hassle of getting my motorcycle repaired and then have to try and sell a wrecked bike.
