    Default Doing My Time Not Enough?

    My question involves criminal law for the state of: Texas, I found out today that I have a class A misdemeanor warrant for Theft from over 4 years ago. I also have a failure to appear on the same charge. I have been out of prison for almost a year. The Theft and FTA charge happened before my prison sentence. I talked to the county attorney today and he said they would give me time served on the Theft charge, but not the FTA. I have turned my life around and I am really lucky to have a good job. I would hate to lose it over this. Any advice?

    Alright, since you do not have a reasonable excuse (according to your PM), you should get an attorney - as it appears that even though they are giving you a deal on the theft charge, you are still looking at possible jail time.

    § 38.10. BAIL JUMPING AND FAILURE TO APPEAR.

    (a) A person lawfully released from custody, with or without bail, on condition that he subsequently appear commits an offense if he intentionally or knowingly fails to appear in accordance with the terms of his release.

    (b) It is a defense to prosecution under this section that the appearance was incident to community supervision, parole, or an intermittent sentence.

    (c) It is a defense to prosecution under this section that the actor had a reasonable excuse for his failure to appear in accordance with the terms of his release.

    (d) Except as provided in Subsections (e) and (f), an offense under this section is a Class A misdemeanor. (e) An offense under this section is a Class C misdemeanor if the offense for which the actor's appearance was required is punishable by fine only.

    (f) An offense under this section is a felony of the third
    degree if the offense for which the actor's appearance was required
    is classified as a felony.
