    Default Daughter 16 Moves In With Boyfriend And Parents

    My question involves juvenile law in the State of: Ohio
    I am a single Dad with full custody my 16 year old daughter. She is again pregnant (4 months) by her 23 year old boyfriend (who lied about his age). He has no job and his parents are barely getting by. She has refused to go to school or participate in any home obligation. I have taken away cell phone, car keys, etc. with no impact. She has received a warning by the attendance officer at school. She wants to quit school. In a moment of desperation I signed a note she wrote saying she could live with the boyfriend and parents (thinking it was of no value because it is not a court order). Now the attendance officer says that if she fails to attend school, I will be sited into court. I have checked with the school to confirm that yes she is attending since "moving." Today she failed to show for a dental appointment. What are the legal ramifications of the signed note and what right do he and his parents have to allow this to continue? How do I undo the note?

    You go pick up your daughter and start being a father/parent and take responsibility for her.

    The note doesn't mean anything, you are her parent and you can change your mind.

    Shes pregnant "again"? Wha thappened to that child and was this man the Father? I would seek protective order against him and forbid the relationship. Furthermore if you have any evidence they had sex or even sexual contact before her 16th birthday press statutory rape or molestation charges

    § 2907. 04
    Sexual assault for a person age 18 to engage in sexual conduct with a minor if the actor knows that the minor is between ages 13 and 16
    (1) Six to 18 months in prison, (2) if the actor is less that four years older than the victim, a $ 1,000 fine, or (3) if the actor is 10 or more years older than the victim, one to five years in prison.

    The first pregnancy was terminated. The 23 year old impregnated my daughter twice. The Ohio Law does not consider the second pregnancy statutory rape because she was 16. The law covers girls up to 16 (age of consent), in other words she has to 15 for those charges to be filed. This I discovered when I did talked with the police and the prosecutors office concerning the rape charges.

    As far as the first time, charges cannot be filed because of the second pregnancy occurred at 16. Again, the prosecutor would not take the any action no legal action was taken the first time. Believe me, I tried to pursue rape charges.

    At this point I am considering a protective order but, I am cautious of further alienating my daughter from me. I was hoping that she would discover what a waste her situation is of her potential to complete high school and college. She has no idea of what bringing up a baby entails. Now, I see that this will take allot more time than I have patients for. She is planning on keeping the baby instead of adopting it out.

    Your concern is your daughters safety no she will not like it but as you can see the consequences are life altering. I have daughters and I can tell you if I let the guy live I would be getting that protective order

    1. Go get your daughter and bring her home.

    2. File for a restraining order against her adult BF and his family.

    3. Physically take your daughter to school, walk her to the principal (or dean)'s office and show them that you have brought her to school.

    4. If not in counseling already, call and make an appointment for family counseling ASAP.

    5. If daughter leaves, report her as a runaway. Ask the school to notify you as soon as they are aware that she is not in class, then you file another runaway report.

    6. YOU are the parent, SHE is the child. Do NOT allow her to dictate anything to you, you have full legal and moral authority over her until she becomes an adult.
