    Default NYC Problem Roommate

    My question involves a roommate in the State of: New York

    I have lived in a 2-bedroom apartment since June 2006. Last summer, I got a new roommate. Things were just fine for the first few months. Now, for some reason I don't entirely understand, she has become a hostile, unstable person to live with. We are not even on speaking terms. Friends who visit my apartment cannot believe how rude she is and the general hostile ambiance her presence creates.

    I tried cleaning up more, doing more than my share even though I am home much less frequently than she is and therefore generate less mess. I tried being friendly. I tried simply staying out of her way. Now I'm sick and tired of feeling unwelcome in my own apartment and I want her out.

    Her name is not on the lease - it's only in my name. The lease ends in July. What actions can I take to get her out sooner? Thank you in advance.

    Does she pay rent to you or to your landlord?

    Are you in New York City, or elsewhere in the state?

    I am in Manhattan, yes.

    Every month, we each write a check for 1/2 of the total rent, stick both checks in an envelope, and one of us gives it to the landlord.

    Then she has a plausible argument that, even if she's not on the lease, she's the landlord's tenant and not yours. Also, NYC has more complicated landlord-tenant laws than the rest of the state, such that people are commonly advised to seek legal help for evictions. See if you can get a free consultation with a lawyer, so you can get a sound idea of what you need to do.

    Thanks for your help - I really appreciate it. This is sort of a follow-up question:

    I got a note in the mail from the building management indicating that my lease is ending at the end of June, and that I need to let them know in about 5 days if I am renewing. Right now, I want to renew the lease, but have someone else move in. Does she have any right to stick around once the lease is up?

    If you want to end your rights to the apartment, end your lease.

    Otherwise, the choice to renew or not renew has no impact on your relationship with your roommate.

    Okay, so if I understand correctly, my options are moving out myself or having her leave voluntarily?
