    Default I Got Caught Shoplifting In JCPenny

    My question involves criminal law for the state of: southern California (orange county)

    I was caught shoplifting in JCPenny april 1st...
    I bought a 17 dollar shirt but decided to just slip my another item in my purse... it was 20 dollar sterling silver earrings.. Right when i walked out of the store i was called back inside the store by the LP officer.. i was taken to his office.. he got copy of my Driver License then he asked me to sign 2 form of document. One was saying i cant enter the store anymore, second one was a civil demand. he had a camera in his hand but did not take picture of me.. he seemed like a nice officer and was trying to calm me down the whole entire time.. he said he could of easily called the cops but he said he wouldnt on me.. : ( From reading many informations online it sounds like JCP can have police involved later after i pay the civil demand... it also seems like some people who reside in california got a summon from court before civil demand letter even when the police wasnt involved.. I still have not recieved anything from JCP legal civil recovery department like they said i would within couple weeks.. i even called the LP office today and they had no answer for me. they told me the civil demand was out of their hands.. that the legal department handles it.. thats why they dont know how much later it will take for the letter to get to me or how much the "fine" is going to be..
    will this go on my record???? i am scared to death.. i cant even go in a department store anymore... any advice will help me tons... thanks..!

    You will be okay! You will learn from this. NEVER, ever do it again! I will hope and pray that they don't press charges.

    As far as the civil demand goes, I am currently being prosecuted for shoplifting at JCPenney. I received the civil demand notice almost exactly three weeks after the date I was stopped at JCP.

    From reading on this message board and others, in some cases, I have heard it takes more time. If you don't receive your civil demand by May, private message me, and I can give you the contact number of the civil recovery service.

    I paid the demand in full, but the letter had phone numbers you could call to make payment arrangements. The civil demand will come from a firm called Palmer, Reifler, and Associates, not JCPenney.

    so yes... sorry guys i already posted my situation already but i have gotten one reply and i am still not hundred percent secured.. please help mee

    it was a 20 dollar item i stole from jcpenny. LP officer said he wouldnt get police involved and hoped i learned my lesson.. but how can i really trust him?? anyhow the civil letter is going to say "These civil proceedings do not prevent criminal prosecution for the alleged act of retail fraud." so meaning even if the civil demand is paid i can get criminally be charged??

    if i was to be criminally charged wouldnt the police already have contacted me?? can JCPenny even get me criminally charged even if the police was not called at the time?? how would i get criminally be charged later?? will i get a letter later saying i have to show up in court such date??? is going to court only way to get criminally charged?or does it work differntly?? i know if i end up in court there is court fee.. wouldnt JCP also be resposible for their own court fee and such?? so over all they will end up looseing money to charge me with a crime.. right?

    JCP has a year to file criminal charges.

    My crystal ball is out for calibration, so I can't tell you if they actually WILL file charges, but they certainly CAN, even after you pay the civil demand.
