My question involves real estate located in the State of: California
There is an old dilapidated fence between my back yard and the neighbor's back yard. A few years ago, the neighbor had a trellis built about 18 inches in from that fence, on his property. The trellis spans the length of the old dilapidated fence and is exactly as tall as it is.
I want to tear down the old dilapidated fence and build a new one. If it's on the boundary between my neghbor's yard and mine, is he legally obligated to pay for half of the expense, even thourgh he built his own trellis close to our property line?
My thought is that he will benefit from a new fence in that it is more secure than a trellis and also will provide him with more privacy for his back yard.
