    Default Can I Apply For Reentry?

    I entered the US in 2000 legally and overstayed by 6 years,i am a UK citizen who was convicted of a violation charge in 2006 , i was deported 2 months after the conviction in 2006 and barred for 10 years, i had no visa and entered under the Visa Waiver Program . I had my life there including many good friends and work too , as i have no criminal record what are my chances of reentry sooner than 10 years ?

    Your chances are pretty slim, absent proof of extreme hardship to family members remaining in the U.S. I expect that you'll be waiting out the full ten years before you are again eligible, and even then your past overstay may interfere with your obtaining a visa. (Post-overstay, you're not eligible for the visa waiver program.)

    Thank you for your reply , i have a girlfriend in New York who wants to marry me so we can be together again . Will the process be very difficult for this ? And could it just cause more problems than i already have?

    She can marry you at any time she wishes, consistent with the laws of the nation where you marry, and you and she can live together in the U.K. consistent with that nation's immigration laws. Marriage will not change your period of ineligibility.

    She is American , so if we marry in the UK and live together for a few years and she decides to return to the US there is no possible way for me to return with her sooner than the 10 years i am barred for ? So i have no options as far as you see? I really appreciate your help by the way.

    You haven't described any facts that would constitute a basis for a waiver. Unless and until you do, I cannot know if any such facts exist. Generally speaking, we're talking extreme hardship to a U.S. citizen family member, so I am skeptical that you can make the case. But I have no way of knowing, and I am unable to predict the future.
