My question involves an eviction in the state of: New York
I am posting this because me and my family are being slowly poisoned by cigarette smoke.
I live in a 2 family house and moved in 13 months ago. There was a tenant living in a legal basement apartment.
The tenant has been poisoning us for the last 10 months. She has started smoking heavily every night. Probably around 2.5 packs a night. I have asked her to stop, multiple times, to no avail. She has signed a rider stating she won't smoke. She still continues to smoke. All the smoke goes up, to our residence. I have covered up the vents but that really does not help.
Please don't be rash in pointing me to the landlord tenant court. I have gone there, and I am doing everything that is possible to evict this tenant. This a month to month tenancy. She has been given notice to leave. I had 1 court appearance on April 10th, the tenant refuses to move claiming that its a money issue. The trial has been set on May 6th. We have offered the tenant to forgive her the rent that she owes us, for the last 5 months and 2 months to leave. She stated she needs 4 months to find a place.
She won't move unless she is BOOTED OUT!
My wife and my 20 month old son have started having serious health problems. My son has developed Bronchitis, and had several colds, he also starts coughing at night from the smoke. My wife has developed an allergic reaction to cigarette second hand smoke and coughs at night as well as experiences severe headaches. Both of us can't sleep at night.
I have called police 3 times telling them to ask the tenant to stop smoking. They did talk to her but they have stated that her behavior is not illegal.
Since when is poisoning people something that is considered legal ?
I am afraid that the effects on my wife and my child's health, if the smoking continues, can be irreversible.
Is there anything you can do to help us.
Any advice or help from you will be appreciated.
