    Default Establishing Paternity With A Deceased Father

    My son is deceased and and just had a baby. He was not aware that he was having this child and they are not married. She just had the baby and the hospital stated the father could not be on the birth Certifacate. I do not want this child having a blank where his father name should be. I am his mother and I want it there as much as the mother of the child. What can I do? What steps do we need to take to get this done? We live in California.

    I am sorry for the loss of your son.

    Do you have anything from your son that could be used for DNA testing? Perhaps you still have his personal items like a hair brush?
    I should think that could be used to determine paternity...
    or if your son was not adopted I would think that YOU could have a DNA test to determined you're a grandparent and therefor have the baby's paternity established that way...

    If the baby is determined to be your son's then you can file for visitation and the baby is eligible for your son's SSI survivor benefits.
