    Default Relative Co-Signed For Car, Now Buyer Refuses To Make Payments

    My question involves a consumer law issue in the State of: California.

    My aunt cosigned for a loan on a car for her sons girlfriend. The girlfriend agreed that she would make the monthly payment, she made the payments for a year but now the two of them have had a falling out and the girlfriend is refusing to pay the payment anymore.

    My aunt has made the payment for this month and more than likely will have to continue paying for the car so her credit score will not be lowered. She has the money to pay off the remainder of the loan, $15,000, but there's no way she wants to do this if her sons girlfriend is still on the title. She wants sole custody of the car so she can sell it as soon as it is paid off.

    What can my aunt do get to this result? Or is this not possible? None of the family knows what to do in this situation and I'd really like to find some good solid advice for her.

    Your aunt will need a lawyer and should sue the girlfriend.

    Yet another great example in the "don't cosign a loan for anyone not physically conjoined to your own body" files.

    is the aunts name on the title of the car in any fashion?

    If not, all aunt can do is sue the girl for the money. She has no rights to the car itself.

    Since your aunt co-signed for the loan, she is just as responsible for the payments as the former gf of her son. She will need to make the payments or pay the car off to protect her credit. As the others noted, the aunt will have to sue the former gf to get her money back.

    There are two names on the title, my aunt and the girlfriend.

    Ok - if both their names are on the title the aunt probably can't take the car & sell it. The aunt needs to make payments & then sue the gf as indicated previously.
