    Default Law On When Laser Or Other Electronic Speed Mesuring Equipment Can Be Used.

    My question involves a speeding ticket from the State of: California.

    hi. i am about to fight a speeding ticket through a written declaration and one of my main arguments is to state that the police car that "detected" me using a laser had its engine ON. At the moment of detection, he had actually stopped at an intersection waiting for a right turn. i passed him from his left to his right. he made the right turn and followed me. In that case, i believe, that there was some law that states that he cannot use laser, radar or any electronic device to measure my speed unless he was in a complete stop with its engine !Off!... is that correct? and if yes, where can i find a quote on that law as i am having trouble doing so...

    You are probably having problems finding the law because it does not exist.

    I'm guessing you heard this from a friend?

    I've issued radar citations with the computer ON in the car, the rear defroster ON, the patrol vehicle driving at 65 mph with the radar in "moving" mode and my wife was at home cooking dinner. There are variables which can interfere with the radar and there is a possibility of the unit giving a false reading...however. Radar operators are trained to inendify false readings. Plus, radar operators generally have allready visually estimated your speed prior to activating/looking at the radar unit.

    i see. what about lasers... actually now that i paid more attention to the ticket, i can see that the speed is in the laser box. in the radar box there is a "-" mark...

    i am just guessing ... maybe the law exists here ?

    No such law in California. We can leave the engine on when running either radar OR lidar.
