    Default Third Degree Assault In NYC

    My question involves criminal law for the state of NY.

    I live outside of NY state and have been contacted by a NYC detective and asked to call him to arrange a return to NYC to be arrested and provided a DAT.

    I had a physical altercation with a girlfriend. As I was trying to defend myself her arm was bruised. She reported the assault. Potentially, as a Domestic Violence issue.

    Questions:
    [1]If I don't return to NYC is there a chance that a warrant will be issued on a Misdemeanor A, Third Degree Assault?
    [2]Is an extradition warrant even a possibility?
    [3]I have been given opposing positions on the issue by lawyers. 1) surrender with a lawyer and go through the process. 2) do nothing and either no warrant will be issued or if a warrant is issued I won't be returning to NYC anyway.
    [4]I travel internationally for work, would a NY state warrant pose a problem entering or leaving the country?

    A: Neither I nor anyone else can give you an answer on that one.



    [2]Is an extradition warrant even a possibility?

    A: You will not be extradited from another state on a misdemeanor; if you are arrested in New York state, they will carry you back to New York City.

    A: Hire a lawyer and surrender.

    A: Yes.
