    Default Waiting-Time Penalities For Missed Meal Periods

    My question involves employment and labor law for the state of: California


    I know if an employer fails to provide an employee a meal period in accordance with an applicable IWC Order, the employer must pay one additional hour of pay at the employee’s regular rate of pay for each workday that the meal period is not provided.

    How is the "waiting-time" penalty calculated if an employer failed to pay this additional hour of pay to an employee for multiple workdays going back 3 years? Is it a 30 day penalty per each occurrence?
