    Question Stepparent Adoption Complete In California, Biological Grandparents Demand Visitation

    We live in CA and My ex husband signed off all rights of his daughter, and has not spoke to her since October, His family has been in and out of the picture her whole life they come in and disappear for months at a time until a Holiday comes around or all of a sudden the biological Grandmother misses her, Now that she found out the her son signed off all rights and the my husband that has been in the picture for over 6 years had addopted her she now is striking and threatening that she is going to use her grandparent rights and take us to court, She is just so inconsistant and I do not feel that she is a person that can beniafit my daugter in any way, she keeps saying that she has witnesses that will prove she has a goos and posative relationship with my daughter but of course shell have pictures of the few times she has seen her, i think in the last year she has seen her maybe 4-5 times.
    It seems that for the first time in my daughters life she is not scared to deal with her biolgical father and ex step mother and she NEVER even asks to see or tlak to her biological grandmother....what are the chances that she will actually get grandparent right granted in CA,

    No one can make any predictions as to whether or not she will get what she wants.

    It would seem to me, however, that if her son signed away all rights 6 years ago, and she's only just now finding out about it, she's going to have a hard time proving in court that she's been so involved in the child's life that not allowing her to see the child would be detrimental to the child.

    If she sues, get a lawyer. Otherwise, do what you feel is in the best interests of your daughter.

    If your child's biological father consented to an adoption, and the child has been subsequently adopted by your husband, this lady no longer has a granddaughter and has no standing for grandparent's rights. She has her son to thank for that...
