    Default Medical Bills In Indiana

    My late husband was on my insurance policy but had signed his own papers for responsibility of his bills on each doctor's visit. In late 2004 we received a letter from a lawyer regarding medical bills and a questionaire The letter basically said fill out questionaire and respond before a certain date to avoid further action. I called the firm and asked what this was about. They said fill out the form which consisted of our income and expenses and send them a check for what ever I could afford at the time by a certain date. I told them the clinic needed to resubmit certain bills as these should have been covered by insurance. I filled out their questionaire and sent them a 25 dollar check. I did not hear anything else from the firm or the clinic until 2 years later when I recieved a summons no date on the paper anywhere I called them immediately and asked what this was about. I have been in touch with them ever since requesting they resubmit the medical bills I have been in touch with my insurance company also but I am getting no where with them. The insurance company is telling me they will not pay for claims over 2 years old. The firm waited 2 years before they sent me more papers this does not seem right as insurance would have paid it all if it would have been resubmitted as I asked and they had not waited so long. They put a judgement on my credit report even though I had been in touch with them and was responding to the firm to get this settled Why am I at fault for this they are trying to add over 2000. in interest on these bills that I thought were taken care of since we had not heard anything else after filling out the questionaire that showed our expenses were more than our meager income from social security disablility and my small pension. I live in Indiana

    Generally, spouses are responsible for the other spouse's medical bills.

    Since you did not appear for court, they got a judgment against you.

    When did that happen?

    There never was a court date set. They filed for a default judgement which should not have been since we were in contact with them. I just received an order vacating default judgement the other day after I called the firm informing them we were not in default as we had been in contact with them. Why should I be responsible for these bills let alone adding interest if I did not hear anything from them in 2 years and now the insurance states they will not pay because it has been 2 years.
    I thought a settlement was made or the insurance paid when I asked the clinic to resubmit the claims after not hearing from collections for 2 years.

    The SOL for the collection of a medical debt in Indiana is 6 years.

    Not sure seniorjudge is correct here. In Indiana the doctrine of necessities does control if you may be liable for the debt and depending upon the entire situation, you may not be liable.

    If the amount of the debt warrants it, speak with an attorney that can review all the pertinent details.

    Since In. is not a community property state & there are some states that no longer recognize the doctrine of necessaries, I agree that it would be worth running by an attorney.
