    Default Why Is Renting A Room In My House Considered A Commercial Activity

    and renting the whole house is not , or is renting the whole house a commercial activity as well?

    Below is a letter I got from planning department today



    Although a single family dwelling unit may indeed be occupied by unrelated individuals, the definition of “family” requires that the individuals living in the dwelling unit live together as a single housekeeping unit under a common housekeeping plan based on an intentionally structured relationship. What this means is that the renting of rooms within a dwelling unit generally does not fit the definition of a single family operating as a single housekeeping unit under a common housekeeping management plan based on an intentionally structured relationship.


    Furthermore, the renting of rooms for financial compensation within a building is a commercial activity, and, additionally, the renting of individual rooms within a building fits more closely with the definition of hotel, lodging house, or rooming house, rather than a single family residence.


    All the laws and ordinances in the state of Nevada say Hotel, Motel, Lodging Houses, Rooming Houses are accommodations that are held out for rent to the transient public.

    I want to share my house with others, the others are not transient, therefore I think planning is way off.

    They have explained how commercial use fits into your idea very well with the exception of how you define "transient".

    All that is meant by transient is they are not permanent. Renters are typically considered to be transients due to the fact they do not own the building and they can be evicted regardless of their desire to stay put, therefore, there stay is indefinate and insecure.

    Granted, there are home owners that move more often than many renters but the fact they have a commitment to the property as an owner, it changes how they are percieved.

    So, since you would recieve income from renting only a portion of the house, it removes the situation from single family. (most families do not rent to each other in the situation you speak of. It is most often renting to an unrelated party)

    Granted, renting an entire house would also bring these transients into the same situation BUT that is not what the rules are stating, you only sought that out as a clarification of the rules. The "single family" or "single housekeeping unit" is what is stopping you from renting just rooms.
