    Default Retail Fraud Second Degree In Michigan

    I was arrested for shoplifting and i just received my cournt notice. i have not spoken to a lawyer and i am curious if i do need one.

    A friend of mine spoke to a law teacher at a local college and he told me to plead guilty (as i had already planned) but to ask for assisted.

    I would just like to know what the best plan of action would be.

    First and foremost, you should have an attorney PERIOD. Whether you pay for one or get a court appointed one, its your right to be represented and you should be to protect yourself.
    Secondly, the advice you received was good advice if you WANT A CRIMINAL RECORD. The law teach is being asked to answer a question and may not have all the details. I don't recommend it though unless there is more to the story, so please answer...

    What was the charge felony or misdemeanor? If you don't know, what was the amount?

    Was this your first offense and do you have a clean record?

    it is a misdemeanor and a first offense. i dont have a record.

    how exactly do i get a court appointed attorney?

    When you go to court, the judge should ask you if you have a lawyer.

    Then once you get a lawyer, tell them you'll do whatever to keep your record clean. See if your neck of the woods has a diversion program. He'll most likely enter a not guilty plea for you...you do what they say (be good, complete a program, community service, whatever) and then it goes away. Hopefully.

    Pleading guilty makes you have a criminal record which I'm sure you don't want. If you end up with one, then at least you tried not to have one.

    the court notice i recieved says to appear at the court within ten days. does this mean that is my actual court trial. and how much time would i need to get an attorney. (a court appointed one)

    the letter came a few days late and thursday (2 days from now!!!) is my only available day. is it too late?
