A few years ago my daughter was arrested on drug-related charges. She went to prison, went through a rehab program, was released early, and successfully completed off probation. She has turned her life around, and has a stable (but financially poor) family life with a new baby. She has regularly been paying restitution stemming from the arrest.
She was pulled over last night and learned there is a bench warrant for her arrest on an old hit & run that occurred many miles away, in her drug days. She was unaware of the warrant until last night.
I have advised her to contact the municipal court, police station, and city hall where the warrant was issued, and she did this. They have told her she needs to pay $100 to dismiss the warrant, plus provide proof that she is paying the restitution amount of $6,000 to the insurance company of record.
When she was first released from prison and followed up on the hit and run (of her own accord), the insurance company had demanded she sign some sort of promissory note toward "future injury" that I advised her not so sign. Consequently, she never actually started paying them, even though she had been willing - I mean, who in their right mind would sign a promissory note for "future injury"?
Anyway, I don't know whether any or all of the information I have provided is relevant, but her question is due to her financial situation, and is this: is there a statute of limitations on the requirement to pay restitution? I'm guessing there is not, but promised her I would ask somebody who knows more than I do.
