    Lightbulb No I-94 No Documents At All

    I am a canadian citizen i went to the us and overstayed my time there i have no idea there was no forms given eg I-94 that i have had in past and have returned on time with this time around there was nothing so i am assuming that canadians can go to us for 6 months with that 6 month time frame i overstayed an additional 3 1/2 years ... Once again i presume seeing i was never given any papers or documentation on entry i returned back to canada in january 2008 . I was never aware until now that i may be barred or banned from the us due to this overstay...how do i find out if i am because i have a child with a us citizen now and she is with me here in canada she was born in the us . What can i do to go back to the us if in fact i am barred ? We have talked about getting married will i be denied a K-1 due to this ?

    We cannot guess whether you will or will not be denied a K1 based on your overstay.

    You need to talk to an immigration attorney about your options.
