I signed a contract for the sale of my mobile home about 2 years ago with monthly payment arrangements. The buyer was to pay me and in addition pay the owner of the land. He has always paid late to me and to the land owner. Since December I have not received a payment on the mobile home, all I've gotten is promises, he has however continued to pay the land owner, late but he's still paying.
The contract did stipulate that should him be more than 15 days late on the payment "buyer should be considered in default of this contract and all moneys paid up until that time by buyer will be forfeited. Buyer will have no legal rights over the above mentioned property and seller will be free to dispose of such as it is best suitable to seller."
Since this was a purchase agreement and not a lease I cannot do a normal eviction even more so since it is a mobile home. What is the best way to approach the eviction since it's been over 4 months without payment and I really don't think I want to deal with this people any longer. I would like for them to ether move out or pay in full the balance on the sale so that I have nothing to do with the property any longer.
