    Default Zoning Code Violations

    I own a parcel of land on St. John USVI. It's zoned R-4, commercial medium density. There's a large 62 unit construction project below my property. Last week, we filed a complaint in Superior Court on St. Thomas citing privacy nuisance due to code violations, density, building height and lack of lateral support. The project exceeds both the density and the 3-story height limit.

    Besides filing a Complaint, is it a good idea to file a Lis Pendens as well? Time is not on my side since everything takes such a long time to move through the courts. I would like to do something out side of the courts as well.

    Will the owners who purchased units from blue prints be able to close on their properties, get a loan and a title policy is there's an existing Lis Pendens?

    Default Filing a Notice of Lis Pendens

    Whether or not you should file a notice of lis pendens is a decision that you should make in consultation with your lawyer. Filing lis pendens when you don't have a legal right to do so can create the basis for a lawsuit against you, so it pays to be safe.
