    Default Pregnant And Divorcing- Last Name On Birth Cert.

    I got pregnant before marriage. Got married. Was only married for 1 month when husband left me and filed for divorce. Divorce cannot be finalized in state of Texas until birth. I never changed my last name to his, and am planning to give daughter my last name, as the husband is no longer around and will be divorced right after her birth. I know i have to list him as the father, but do i have to give her his last name on the birth certificate? I'm afraid that he will try for this. I cant stand the thought of having to call her by his last name for the rest of her life. it seems ridiculous that my daughter and i would not have the same last name, as i will be the primary care taker of her. Is there a law that states whether or not i have to give his last name?

    He has every right to seek an order giving his child his name be ready for a court battle
