I am the primary custodial parent for my two young children (7 & 5) from NH. My divorce was finalized 2+ years ago. I have sole physical but we we share legal custody. My ex husband moved out of state two months ago for no reason. He has been non-compliant with child support since our court hearing last year, has cancelled most of his visitation with the kids over the last five months (before he moved) and just contacted us to let us know he was gone. Now he has asked me to send my two young children to visit him on the other side of the country for a week this summer. (In our decree he was allowed 1 week of summer visitation- but it was not stated outside this state, he was living here at time of hearing.) So my q?'s are:
1) Can he really take them out of state even if I disapprove? I suggested he visit them here because they have never flown on a plane, they have never spent more than 2 days away from me and they haven't seen him in months.
2) Since I have no idea where he is or where they would be going, can I refuse this?
3) If he pushed this legally, what can I say in court that would be in my favor? I don't want to look petty but he has been unreliable over the last two years and I don't trust him, he may not even send them back if he was mad enough at me.
4) In court- what chance would he have of winning this visitation?
Any help someone could provide me would help considerably. I am so worried about this, my family thinks he is grasping at nothing because he has no chance at this, but I just don't know....
