The LT act in AZ favors landlords.. and is also very vague. Here are the two statues and my two questions:
A. The tenant shall not unreasonably withhold consent to the landlord to enter into the dwelling unit in order to inspect the premises, make necessary or agreed repairs, decorations, alterations or improvements, supply necessary or agreed services or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workmen or contractors.
--the other day my landlord called and said that she wanted to show the house in an hour (tenant occupied rental). i said that we had a bunch of company over and asked if she could do it some other time. now she's saying that she can evict me because i witheld consent. do i not have the right to decline? there is no provision in the lease about showings... it just says SHE has to give us 2 days notice to enter.. but her reasoning for giving us less time is that other realtors aren't our landlord.....
D. The landlord shall not abuse the right to access or use it to harass the tenant. Except in case of emergency or if it is impracticable to do so, the landlord shall give the tenant at least two days' notice of the landlord's intent to enter and enter only at reasonable times.
--what is impractical to do so? landlord claims that giving an hour notice to show home is practical, however, i have nothing to do with the house being sold and i want 24 hours... at least! 2 days is what the LT act says...
