    Default Rent Increase In Lease Take Over

    Hello,

    I currently live in a 1 BR apartment in Manhattan. My lease expires in 6 months but I'm planning to move out to a new apartment. I currently pay 1400 a month but my landlord tells me that for the remaining of the lease, he wants to charge the new tenant 1600. Is that legal? That makes it more difficult for me to find somebody to take over my lease, so I don't know how to handdle this situation.

    Any help will be greatly appreciated.

    New York City has its own set of landlord-tenant laws, and I'm not going to delve into them. In general, they work in your favor. There are a bunch of tenants unions in NYC and you should consider consulting one of them.

    In general, if the landlord tries to charge more than the outstanding rent, a court would likely view that as a failure to act reasonably in seeking a replacement tenant, and thus could disallow a claim for rent owed during the remainder of the lease. I suspect your landlord is concerned about whether he could successfully raise the rent for a new tenant at the end of the six month period, if he initially rents at $1,400/month.
