    Default Advice On How To Do A Plea Deal

    Ok..

    I got busted for doing 71 in a 55.. I am not contesting that...

    It has been over a year since my last ticket..

    ******
    Last time I got a ticket in a different county, a lawyer saved me a couple hundred dollars and told me to contact the prosecutor and work out a deal.

    I did that, and it took about 15 minutes...

    Showed up to court and paid my fines..

    (No points were taken from my license)
    ******




    This time

    I just contacted the Champaign County, Ohio, prosecutor and was told by his secretary that he does not talk to defendants wanting to plea a deal..

    I would have to get an attorney...

    Which I think is a joke and a waste of my time and money...


    Is it ok to wait until my court date and ask the court for leniency that day..

    I am only asking that no points be taken from my license and a reduction of the Traffic Ticket Price...

    Or should I pony up and pay for a lawyer..

    So much depends upon the state in which the alleged violation took place. I think, in most states, it wouldn't be cost effective to hire an attorney but you might contact a court clerk in order to find out what your options are and what you can expect. They can't give you legal advice but a polite conversation can reveal much of what you need to know in order to make a good decision on how to proceed. Good luck!

    In the state I reside, PA, its fairly easy. The statute that I negotiate to is a PA-3111A (failure to obey a traffic controlling device) which carries no points.

    In other states, I try to find a similar statute that I can cite or I try for a "jurisprudence in abeyance" depending upon the state which too carries no points.

    While not legal advice, the following, may be helpful.

    In the meantime, you may want to familiarize yourself with your state's statutes to if there exists such "generalized" traffic violations that may be more favorable to your driving record than a speeding citation. Remember, Google is your friend.

    Perhaps an impromptu question to another officer may also provide you with some additional insight into these other more preferred statutes or a conversation with your state's department of transportation.

    If the road, you were traveling, moves at an average that is higher than the posted limits, you might want to inquire into the often required roadway traffic survey which justifies the posted limit.

    At the end of the day, I believe the most important thing you can do to maximize your chances of a successful plea deal is to carry and project a positive attitude. Above all else, your ability to keep it positive will most likely dictate the outcome of your "challenge" either in court or at the window.
