    Angry Apartment Manager Refuses To Return Deposit To U.S. Visiting Family

    OK here the shortest why I can describe this issue:
    My wife's mom and dad got a Apt while they are here visiting in the USA (Not US Citizens)
    They told the landlord their situation and will need a Apt for about 6 month lease or whatever.
    Everything was good the whole time they lived there.

    Before they had to sign a new lease they wanted out and gave warning notice about 30 days before the lease was expired.
    The notice was given and her parents even noticed that there was a orange tag in the mail box for a change of address, now why would they have put one of those in the mailbox if they got no warning their tenets are moving out?? (Because they did get the warning and now they are denieing it)

    They had a date that they had to give back the key and sign the moving out papers.
    Lets say the date was the Nov 19 at 1:00pm they had to sign the papers and turn in the key. They went in on Nov 19th but didn't get there until about 2:15pm
    Now what they are saying is since they got there at 2:15pm and it was after the 1:00pm deadline and now they have to sign a new lease and they have to pay for this new month... WHAT! over $1,000.00 because they were 1 hour late?

    The Apt office said they gave the the Apt manager office no notice they where moving out? Her parents gave a written notice they where moving out with the rent payment the month before, It was in the same envelope as the check for rent.
    They said they didn't get it, but they got the rent payment?...

    Now for whatever reason I think they got the extra month they where told they had to pay expunged, but now they refuse to give back the Deposit of around $700
    The Apt was left spotless, no damage to anything, no stains on the carpet. New tenets could have move in that same day it was so clean. They never even wear their shoes in the house, They are from Indonesia.

    They keep giving them BS excuses like how they were 1 hour past deadline and gave no notice is to way they are not paying back the deposit.
    They have been not answering the Apt office door sometimes when they know they are in there, or returning any phone calls.

    Her moms doesn't speak any english but understands some.
    Her dad speaks english to not at 100%
    Her Aunt, who help get them the Apt speaks english very well, she tried to help but the apt manager is giving her the same BS excuses also.

    Her parents are afraid to do anything because they are only visiting here in the US and they are always afraid of causing a problem.
    and with their shyness, I think the apt manager is taking advantage of them because of there imagration status and thier ability to speak english well.
    It's almost like the Apt manager is thinking, if he causes so much of a problem for them they will just go away, and that it now basicly what her parents are doing now...
    But I say wait! I am 100% american and I know this is not right!

    What can we do to get these people to pay back the deposit and stop treating my wife's family like they are a bunch of illegal imagrants...
    I would like to go down there and speak with them, but I would like to know where I stand and what I can threaten them with legaly.

    My wife's parents are very nice polite people and I think are getting taken advatage of because of this.

    Can someone help please? Let me know what other information you may need and I will get it ASAP

    The relevant jurisdiction is where this apartment lease existed, not where you live. Unless it's the same, but you haven't told us that.

    If your parents feel that they are owed a refund, they have recourse through small claims court.

    Here's the main question I was trying to explain.
    Sorry, I probably should have just explained it like this before.

    Date was the Nov 19 at 1:00pm that her parents had to drop off the keys to the APT.
    They went in on Nov 19th but didn't get there until about 2:15pm

    Now what they are saying is since they got there at 2:15pm and it was after the 1:00pm deadline. Now they say they have to pay for the new month of a full months rent...
    Over $1,000.00 because they were 1 hour late dropping off the key?
    Now they refuse to give back the deposit becuase of this..
    shich was around $700

    Who is in the right in this situation?

    Do you think if "we the tenants" vs. "APT managment" who would be in favor in this situation?
    Also, would they be in the right to get more money from the APT just for causing them this much trouble to get back their deposit And also fees for needing a interpreter?

    I live in Marysville, Wa and that is also where to APT is located.

    It was already answered. Mr. Knowitall advised going to small claims court.

    Beyond that, all of your questions require speculation. No one here knows who would prevail. We can speculate til the cows come home, but it won't be helpful for anyone.
