    Default Nonpayment Of Wages And Hardship Lawsuit

    I worked for a company since November of '07. I just resigned this last sunday. This company has screwed me over almost every single week on either not paying me what I was suppose to be paid, extra charges on my check that noone knows anything about or my check being sent somewhere else in the US or a check not even being processed for me. It took me almost 6 or 7 weeks to get my first check when I should of received it on my 3rd working week. I have had my electric/gas shut off numerous times, my vehivle repoed 2 times counting yesterday, I have fought 2 evictions and more. I have been told it is because the company has a few other people with the same name as me and thats where the mix up is at. Noone has an answer as to why I keep getting these misc charges to my account. I am paid weekly commission only. I am married with 4 children. Does anyone think I could sue and get a more out of the company then the actual dollar amount owed because of hardship or should I just take this to small claims and work it out there. The total that is still owed to this date is almost $1,000 that i know of. Any help would be grealty appreciated.

    Also this company pays its SRVP's over $1 Mill a year, do you think that asking for at least $500,000 would be too much?

    Yes, I think that asking for $500,000 when $1,000 is owed is considerably too much.

    I live in Indiana, the reason the asking amount would be so much is because of all the problems that I occurred because of it. With the loss of power/gas, vehicle and almost home and marriage, I thought maybe it might not even of been enough, but maybe my anger is speaking too loud. its just being promised every week for 5 months that it wouldnt happen again got a little out of hand and yes I do take some blame for sticking around as long as I did, its just I have seen the potential opportunity at that company and maybe got sucked into a fairytale.

    You can put in a wage claim with the Indiana DOL - they can only pursue claims of more than thirty dollars ($30.00) and less than six thousand dollars ($6,000.00).

    If you pursue a lawsuit on your own through the Indiana small claims court system, the max. amt. you can sue for is $6,000. Any amt. over that would have to be handled in a higher court with a lawyer.
