    Default Would A Judge Reconsider A Name Change?

    State=GA

    I think that I know the answer to this question but I was hoping that maybe by some miracle that there is a statute of limitations or time frame.

    I am an unmarried mother and when my DD was born I gave her my last name. Dad left halfway through the pregnancy. We went to court when she was 7 months old to establish paternity, custody, visitation and CS. He also asked for her surname to be changed to his. At first the judge didn’t rule on it but then I found out about a month later that he did allow the name change.

    I asked my lawyer about what I needed to do and I was told that Dad’s lawyer should handle it b/c it was his request. In the meantime I still have my DD with my last name since all my/her records have her with that name.

    I’ve asked Dad about it several times. He said he would talk to his lawyer. A couple weeks ago I took her to see a medical specialist and there was a problem because the referral was made in one name and the insurance had her as a different name. When I asked Dad again if he had legally changed her name he said that he had not. He also denied that he changed her name with the insurance company but that was obviously false as the card had her name changed. It has been 5 months and he still has not filed for a new birth certificate.

    I am going to have to change her SS card, all my military documents, her medical records, my will, life insurance stuff etc etc I can’t do it without a new birth certificate so I admit that I am bitter about having to change her name. I will get over it. I feel like I am just sitting around waiting for him and that he is dragging it out for no reason other than to make me mad. I just don’t understand why if it was so important for her to have his name why he has not changed it legally yet.

    Do you think a judge would reconsider??

    ETA: She is having a minor surgical procedure done this week and I am sure the hospital will give me a hard time about the insurance company again. That is why I am wondering about all this now.

    First, go to the courthouse to make sure that the Judge did actually order the name change. If the Judge did, you should go ahead and initiate the name change yourself so that you can get all the recirds changed.
