My mother died in 1977 and my father died in 1984. All of us children were grown and 3 of us had grown up in the house I'm asking about. My dad remarried in 1982 or 1983, he filed for divorce in 1983 also, but she moved back in with him. For lack of better words I will call her SM (for stepmother) When Dad passed away SM would not allow anyone access to his papers. I was not there because the factory where I worked was closing and I did not have the money to get to Florida. The mortgage was in his and my mother's names, if anything was owed on it , it could not have been much as Satisfaction of Mortgage was issued in 1986. We found out a few years ago when SM tried to sell the house that my sister and I were on the tax papers as owners or remaindermen with SM as having Life Estate. After finding out about this we did some further checking online and found SM had also taken out a mortgage right after my dad died which she paid off. Now she has allowed the house to become in deplorable condition, so bad Miami-Dade's mayors office along with Habitat for Humanity was going to tear down the house and build her a new one until they found my sisters and my names on the house. Now SM is in a home for the aged, there is a lien on the property for code violations & probably more being added as time goes by, last years taxes are unpaid and she will not sign over her rights to the house to us. There is someone calling wanting to buy the house from my sister & I but we are not willing to share with her, we have good reasons besides the fact that she had use of the house for over 20 years. My children & I had actually been homeless for a little while during that 20 years because I was out of work & had to chose between feeding the kids or paying the rent! What can we do besides waiting for her to die? She is only 8 years older than me and with the luck I have she may out live me! I'm disabled and can't afford an attorney any advice would be appreciated.
