I moved in on Nov 4th 2004, there was a 3rd roommate who moved out without notice on Nov28,2004. She had caused major problems between me and the "actual" leaseholder, and tried to take a "me or her"stance. The lease holder told her she would not choose. She was more then willing to let her stay if she got a job and was willing to pay her share. She moved out, she took a bag of clothes that was it...
Her room remained as was for 4 months..then when we took another roommate in , in which, we finally moved the absent roommates possessions to the garage..
In that 4 months she (absent roommmate) had called and made arraingements on several occassions to come get her things, which I would leave for days at a time, to allow her to do this without me present. She either neither showed on these arrainged times, or would just come over and "hang out". Not removing her things, or a little here and there.
At one point in May she came over and took the "leasee's" furniture and GAVE it to Goodwill. That's another issue. But said that she would not be back.
Now here it is a year later (less two weeks).
When she left, she also abandoned her cat. Which I and the leasee have been caring for and supplying all of it's needs and care, including but not limited to it's neuter ( it was spraying), vaccinations, Advantage for fleas, and all food, toiletries, and toys.
She had called periodically over the year "threatening" to take the cat which the leasee had rasied from a kitten and considered her own, if she didn't pick her over me, still!! She never showed.
Three weeks ago she started calling. First stating she had gotten a new kitten and wanted the cat she had abandoned possessions,( ie. cat carrier etc), and has been calling since saying she wants her things she left. She was told she had been gone a year and anything she may have left here was considered abandoned and she was not welcome or allowed here. She had ,had ample time and opportunity to retrieve it.
Yestererday I noticed that things were missing around the yard and out of the garage (garden hose, lawn chairs etc).
NOw she and I just got into a huge argument about how she has had a year and she broke the law coming over here without consent or our knowledge. And that she has no rights on this property, and that I will get a Trespassing Warrent against her if I can.
What I need I guess is an answer to a time limit for claiming abandoned property, and what my rights are for getting rid of her things.
She was never on the lease, so there is no "landlord" rules that apply to my knowledge .
And the lease has been renewed since and I am a legal lease holder.
