    Default Adverse Possession Land

    California

    There is a small 1 acre land locked parcel land at the back of mine that is over 5 years behind on taxes and is in default, the land is owned by a corporation that was suspended years ago and no longer operating and the address on title is an apartment that has changed renters many times over, there is no other contact information.

    What is the best way to use adverse possession to obtain this land legally and quickly?

    In California, adverse possession requires five years of continued use which is "open and notorious" and "adverse" to the owner's interest. The maintenance and upkeep and improvement of the property is required and for the five years of use the property taxes must be paid for the property being adversely possessed.
    You would stand a better chance either purchasing the parcel from the owners or if the land does end up getting sold (because the taxes are delinquent) purchasing it at that time.

    Hello HT thanks for response

    Its a suspended corporation that originated in the early 1960's owners are no where to be found, its been in default 5 years do you know how long is it required to be in default before its sent to auction?

    This site states it is 5 years (certain circumstances it could be 3).

    You can contact your county and see if it is coming up for auction. Because it is landlocked, it is likely that not too many people would be interested in bidding.
