    Default Legal Age In Virginia

    Two months ago a neighborhood family was in crisis and ask that I help. We agreed he could stay with me and we would work together on a solution. The child started counseling, the mother continued with her counseling, sought psychiatric treatment for herself, and everyone continued to work towards the goal of him returning home. Today the child and I were asked to attend mediation with the mother's counselor. In my opinion, it was not mediation, it was an intervention. In short, the counselor told me to turn my back and not offer a home so that the child would be forced to move back home. If I did not agree, CPS would get involved. The child is a junior in high school and turns 18 in 11 days. Legally on the child's 18th birthday, can he choose to live with us?

    No.


    In the state of Virginia, if the child is still in high school at the age of 18, then s/he is not considered legally emancipated until the age of 19, or upon high school graduation, whichever comes first.

    What if they don't graduate from high school? Can they then be of legal age at 18?

    Why do you feel the need to keep this child from his Mother? If court feels it ok why do you think different.
