    I am not trying to confuse you. I was a stay at home mother he filed for divorce in Montgomery county we lived in Davidson county. TN law says you have to live in the county for 3 months before you can file. He filed inappropiate marital conduct(he was the one that had a girlfriend) He was home every night. I didn't get served, knew nothing about it. Eight months later he gave my mom a divorce decree his signature and a judges and his lawyers it was not certified/stamped it was dated not long after he stopped coming home so he did this while he was home. There was a paper where he was suppose to keep insurance and he gets every day as his time I get 2 supervised visits a year he decides everything school, activities etc. No child support mentioned I didn't have a job or he probably would have asked. He got the car the house everything in the house. No spousal support. So is that divorce by default/ no show. He did that on purpose he was there every night. I am not sure why he could file in that county unless he bought a place there. I don't have a home or car he got them, it is very difficult. I haven't heard from him in 5 1/2 years. I called 911 to report my daughter missing. He came by the house once in 6 months with my daughter let me hold her 5 minutes grabbed her kicked me and shoved me and took her to his mom's car and his mom took her. I called 911 told them he kicked me/shoved me and they didn't fill out a report.

    Ask any questions you want I wil try to answer the best I can. SOmeone from another law board said the divorce is final but I might renogotiate the settlement on the grounds of improper service and that I would have to go to Tennessee and stay and fight there because that is where he filed. Please ask any question you want because I don't hardly believe all this happen either but I am living this. I couldn't believe it could be that easy for this to happen. I have to be missing something. I haven't been able to get a certified copy of the decree. The copy of the decree he gave me was old and stained he had it but is that everything for real??? A judge signed it. The house was in his name but it was our marital home he bought it while we were engaged for us to move in to we lived ther 8 months before we got married.

    A judge signed the divorce decree but didn't sign the papers with the visitation etc. on it. 3 years after these papers the credit bureaus was still reporting him as my current spouse. I guess they are slow at getting updated. He was so quick to do this to me he wasn't thorough he didn't mention retirement accounts or mutual funds or divinding any debts either. He just wanted to take the car from me.

    Default Never signed marriage certificate !!!

    I just remembered something and was wondering about it. I never signed a marriage certificate and we didn't have a witness. The minister was a woman and my husband and I was there no witness and like I said I didn't sign the marriage certififcate. What are the rules in Tennessee??? Should I contact TN vital records for a certified copy ???

    I for one have NOT A CLUE as to what you are talking about. You are all over the place with your posts. I know of no other human being on earth who does not know the following information about theirself:
    1. You don't know if your married.
    2. You don't know if your divorced. First you were not sure and now you have say the Judge signed the decree ? Which is it?
    3. You don't know if there were divorce proceedings or what county they might be in.
    4. You do know that you called 911 for abuse and kidnapping but there is no record of it. You have not mentioned this child until many posts later. So the daughter is at his moms house being raised now? That doesn't seem to bother you?

    Do you have the slightest clue as to how you sound? How in God's name is someone here supposed to help you? You say you know it's confusing but I don't think you have the slightest clue about how confusing it really is or you wouldn't be adding to it.

    I can tell you that no judge would ever grant a divorce with a child in the picture and not grant child support to the parent that the kid is living with. PERIOD.
    I would suggest that you call around to the county court houses that you lived in or he worked in and ask if there is a divorce on file in that county with your name on it. And a child support order for one or the other of you. Someone here should be paying to support this child.
    Why you would keep your head in the sand is beyond me. Poor choices very poor choices.

    You can be a smartass if you want. I didn't do all this. My husband has been to more than one attorney and I have been in one place. Everyone knows where I am at. I have not got sued for child support, we have a working phone and computer etc. I tried contacting his attorney he won't say one word to me. I asked if he had dates and papers or anything he hung up on me. I know his lwyer can't represent me but I asked for papers. When I first posted here I only wanted to know what a divorce be default meant!!! So CRAM IT BITCH!!!!!!!!

    And by the way this isn't how I wanted I to be but her grandparents feed and clothe her very well and protect her fom my husband. They can protect her better from him than I can. My husbands dad stepped in and tries to control him and I am glad for that. And they have money and I can give some back later until my husband settles down.
