    Default Shared Driveway With Gates

    I am in Missouri. I moved to a place whereis the people that live up by the road and I share a drive. This house was their mothers and when built, they only made onne drive in and out for both houses. My house sits about 1/2 mile back. The problem is: They have 2 gates at the end of drive that they claim must be shut at all times. They have no animals, no reason for the gates to be shut other than a control of it. I am disabled and it is hard to have to get out and open and shut it 2 times everytime i come and go. Even when I am only going to be gone 30 min or less, if I leave it open, they run out and shut it. They have a sensor and have even moved their couch to see out the window all the time. They are older so home all the time. They are saying since they lived here first, they have the rights and its their rules.. they even stop every person that comes thru the gate and asks them 20 questions about who they are, what they want, etc. I believe this is a violation of my personal rights. These people are the ones that think they need to know what is going on in the whole neighborhood. we are out in country. also they have lied and threatened me to put a lock on gate saying i would have to walk in the half mile, said they could put up to 12 more gates between the street and where my property starts, which they wouldnt have to open as their drive turns immediately as you come in. their property runs back further to where mine starts tho. I feel like they are always watching everything i do.. they can tell you to the minute when i come or go, which isnt late or anything. I have shut the gate about 98% of the time, but am getting tired of it. They also jump my 16 year old son when he comes or goes and he shuts it as well. Please help and tell me what right i have and if i can have the gates removed.. IM tired of the nuts.

    It's "he said she said".

    You need to get the written documentation for your access rights, if any, and get the opinion of a local attorney. You have no recourse against threatening neighbors until you know your rights and they are probably in writing somewhere.

    I would have a land survey done and have the surveyer put iron stakes 4 feet in the ground to mark my our boundaries and right of way if one exists. If you do in fact have legal documented access to a driveway/right of way then your neighbors can't obstruct your access.
