We own 12 acres of woodland that is landlocked. The property was part of a bigger farm that was broken up years ago when my grandparents gifted various sons parcels of land. About 30 years ago, a sportsman club purchased the vast majority of the old farm. The sportsman club is fairly adamant that they would prefer that we not be out on the property, but realizes that they really can't prevent us from accessing the property at this point. They have been allowed free reign in hunting and using our property over the years and seem to feel that it's more theirs than ours. I would say that we have an antagonistic relationship at this point.
I have a deeded right of way via an abandoned town road to my property. There is no specification for a width in the deed.
I have 2 problems right now relative to this right of way.
The first and foremost is that part of it goes through a wetland and the road is under water. The culverts under the road have collapsed and probably did some time ago. Now that we are using the property more often for camping and such, we need to repair that part of our right of way in order to get to the property without using a 4 wheel drive vehicle or a tractor.
What rights do I have in effecting this repair? I don't see anything on the deed with respects to maintenance. Is there an expectation that the sportsman's club bears some responsibility in the mainenance of the road (ROW). We've cut brush and limbs away from the road so we could access our property without scratching our vehicles up in the process.
I'm not looking to pave or other improve the ROW other than maybe putting some traprock in to secure the replaced culverts.
Because it is in a wetland, do I need to consider permits from the state before proceeding?
The second part of this is the sportsman's club has also built an archery course that my ROW passes through, they are essentially shooting across the access road at several targets at different points along the road. I've already gotten a number of dirty looks from archers as I make my way out to my property. It seems to be a somewhat dangerous situation, but is also their land and I'm not sure what I can do about that situation. I would hope though that some of the same laws would apply to a right of way as would other roads relative to discharge of weapons.
