    Default Contempt Proceedings For Nonpayment Of Alimony

    My husband's exwife just filed papers citing him with contempt of court for not paying her alimony. They were married for only 3 years, no children and lived in Florida, where the divorce is filed. I do not personally know the details of their agreement, they did it out of court, but do know that he paid her 1500/month for over 3 years and also transferred several credit card debt from her accounts to his own. She was supposed to use part of the money to pay down other debts, but has not done so. He did stop paying her all together because he became unable to do so and she was constatly calling and trying to get him to give her more. My question is this, now that the case is being reopened, can he petition for a modificaion of the agreement based on the fact that his income has changed and also her status has changed? She was in school for their entire marriage and now has her PhD in phychology and is living in New York City. He and I have been married for almost 3 years and have 2 children...she is asking for 60,000 more and legal fees. What options do we have here? I personally feel like she has already gotten more than enough and am worried what will happen if we do have to pay this...we will probably lose everything...please help.

    What options do we have here?
    Your husband needs to gather up all of his divorce papers and see an attorney right now.

    You say he stopped paying because he couldn't afford it anymore, so it sounds to me like he breached their agreement. The court will decide if he has paid enough.
